PHOENIX (CBS5) - Three people and three businesses linked to a leader of the organized crime syndicate Sinaloa Cartel face Kingpin Act sanctions imposed by the U.S. Treasury Department.

  • The Treasury's Office of Foreign Assets Control targeted Mexican attorney and notary public Jose Antonio Nunez Bedoya, who officials said helped create front companies in order to conceal and launder assets related to Zambada Garcia, members of Zambada Garcia's family and other members of the Sinaloa Cartel.
    Nunez Bedoya incorporated Estancia Infantil Nino Feliz and Establo Puerto Rico on behalf of Zambada Garcia and he notarized real estate purchases on behalf of Santa Monica Dairy, all of which were previously slapped with sanctions in May, 2007.
    Nunez Bedoya notarized real estate purchases on behalf of Sinaloa Cartel leader Joaquin Guzman Loera and his wife, Griselda Lopez Perez, who were placed under sanctions in September 2012.
    "The Sinaloa Cartel cannot hide behind front companies like a water park or agricultural business," said DEA Special Agent in Charge Doug Coleman. "We are working with OFAC to expose these traffickers' front companies for what they really are - not legitimate businesses, but illegal enterprises that fuel the drug trade, its violence and corruption."
    The cash-intensive businesses sanctioned Tuesday were Parque Acuatico Los Cascabeles, a Sinaloa-based water park; Centro Comercial y Habitacional Lomas, a shopping mall in Culiacan; and Rancho Agricola Ganadero Los Mezquites, a cattle ranch in Sinaloa. Nunez Bedoya incorporated and notarized all three businesses on behalf of Zambada Garcia, OFAC officials said.
    The Tresury Department also placed sanctions on Tomasa Garcia Rios and Monica Janeth Verdugo Garcia, wife and daughter of deceased narcotics trafficker Jose Lamberto Verdugo Calderon.
    Verdugo Calderon was killed by the Mexican military in January 2009. He was widely identified by U.S. and Mexican authorities as a major financial operative and lieutenant for Zambada Garcia. Tomasa Garcia Rios and Monica Janeth Verdugo Garcia own Rancho Agricola Ganadero Los Mezquites and Parque Acuatico Los Cascabeles.
    Tuesday's action generally prohibits U.S. persons from conducting financial or commercial transactions with these designees and also freezes any assets they may have under U.S. jurisdiction.

    Drug Tunnels Have Feds Digging for Answers

    U.S. Agents Can Spot the Passages, but the Brains Behind Them Prove Elusive

    OTAY MESA, Calif.—The federal agents who spend their days hunting for tunnels used to smuggle marijuana from Mexico know the subtle signs of an illegal passageway hidden amid the labyrinth of warehouses in this border community just outside Tijuana.
    They know large tunnels cost about $1 million apiece to build and can take up to nine months to finish. They know the suspected cartel kingpin allegedly behind the most sophisticated passageways—including one with an electrified rail system—that have been popping up on the border at an alarming rate.

    But a stubborn mystery remains at the heart of the drug-tunnel phenomenon: the identities of the people who designed and built these engineering feats.
    As border agents focus on investigating and dismantling networks that fund and use the tunnels, tracking down the engineers is crucial, federal agents said.
    "I would liken that to winning the law-enforcement lottery," said Derek Benner, the special agent in charge of investigations for U.S. Immigration and Customs Enforcement in San Diego. "These guys would just be a wealth of information for us."
    Drug smugglers have been burrowing under the border for two decades. Since 1990, 159 tunnels have been discovered crossing into the U.S. from Mexico. Construction boomed as border security tightened, forcing smugglers underground. In the past four years, the building of illegal tunnels increased by 80%, according to 2012 federal report.
    The most recent was discovered in Tecate, Mexico—about 35 miles east of San Diego—by Mexican army officials in December. It crossed into California but an exit hadn't been built yet, federal officials here said.

    The tunnels are primarily used to smuggle pot into the U.S., but U.S. Homeland Security officials say the passageways pose a "significant security vulnerability" and could also be used to smuggle weapons or cash across the border. Most are found in Arizona and California, though a large number are just rudimentary holes, or tap into existing cross-border drainage systems.
    The most sophisticated tunnels tend to pop up in Otay Mesa, a busy border outpost that is part of San Diego, where the clay-like soil allows for larger and deeper passages and warehouses help conceal tunnel exits. The tunnels are often more than 1,000 feet long, shored up with concrete or wood, and equipped with ventilation systems, phones, lighting, and in one, an electric rail system capable of pushing tons of pot under the border at about 20 miles per hour.
    The tunnels typically begin in a home in Mexico, run under the border fence and emerge in a warehouse district used to store products for legitimate cross-border trade. Border agents usually find them by watching warehouses on the U.S. side for activity that seems abnormal, such as late-night work shifts, or trucks parked out front that never seem to move.
    In 2009, they discovered one beneath a false bathroom floor built onto a hydraulic lift that descended 90 feet below ground. "It was an engineering marvel," said Jerry Conlin, a U.S. border-patrol agent, who said the tunnel had ventilation, lighting and a phone. After a tunnel is discovered, federal officials fill it with concrete slurry to close it, he said.
    Federal agents believe the architects come from Durango, a mining industry state in northern Mexico. They believe there is a small group of trusted engineers—who are highly valued and guarded by the drug lords employing them—responsible for designing and overseeing the construction of the tunnels.
    Federal officials say they know of just one architect who was arrested and prosecuted in the U.S.: Felipe de Jesus Corona-Verbera, who built one of the first sophisticated tunnels discovered at the border, a 200-foot-long passage from Mexico into Arizona used to funnel cocaine. It was discovered in 1990 and Mr. Corona-Verbera eluded authorities for more than a decade until he was arrested in 2003. He was sentenced to 18 years in prison in 2006, according to federal records, and is currently in prison outside Tucson.
    "If you have an engineer who's building you really good tunnels, you'll protect that commodity," said Tim Durst, the assistant special agent for Immigration and Customs Enforcement, who leads a tunnel task force here. "It's the most important commodity you have."
    In the past two years, agents in San Diego seized about 100 tons of pot with a conservative estimated value of around $60 million from various tunnels. In that time, prosecutors have won 20 convictions in connection with tunnels on the San Diego border, said Sherri Walker Hobson, the assistant U.S. attorney for the Southern District of California.
    Federal prosecutors in San Diego are calling on Mexico to extradite Jose Sanchez-Villalobos, after a grand jury indicted him last year on 13 counts of drug smuggling and allegedly financing construction of two of the largest tunnels on the border, including one dubbed the Marconi tunnel. Prosecutors say Mr. Sanchez-Villalobos is a high-ranking member of the Sinaloa drug cartel. His lawyer, Guadalupe Valencia, said Mr. Sanchez-Villalobos denies the charges and is fighting extradition.
    Despite those successes, investigators here and in Mexico have struggled to find the engineers. Investigators believe they know the identity of one, Mr. Durst said, "but we hit several roadblocks in locating that person."
    Officials are perplexed about how the engineers manage to be so precise in constructing a tunnel to emerge at exactly the right spot in the U.S. Mr. Durst believes they use compasses to help guide the work, but he is curious about how they manage without a global-positioning device, which won't work underground.
    "There are so many questions," Mr. Durst said. "What are their techniques? How the heck do they build these things so well?"

    A tunnel designed to smuggle drugs from Tijuana, Mexico, to San Diego was equipped with lighting, ventilation and an electric rail system, U.S. authorities said Thursday, making it one of the most sophisticated secret passages discovered along the U.S.-Mexico border.
    Authorities seized 8 1/2 tons of marijuana and 327 pounds of cocaine in connection with the tunnel's discovery, according to court records. Three men who authorities say worked as drivers were charged Thursday with possession of marijuana and cocaine with intent to distribute. U.S. Attorney Laura Duffy said they face prison sentences between 10 years and life if convicted.
    The tunnel, which zigzags the length of nearly six football fields, links warehouses in Tijuana and San Diego's Otay Mesa industrial area. The area is filled with nondescript warehouses, making it easier to conceal trucks being loaded with drugs.
    The tunnel was shut down Wednesday night, before any drugs made it through undetected, authorities said. Federal agents had the San Diego warehouse under surveillance after being tipped off by an informant who told them that operators bought drills and other construction equipment in August and September.
    As U.S. border security has heightened on land, Mexican drug cartels have turned to ultralight aircraft, small fishing boats and tunnels. More than 75 underground passages have been discovered along the border since 2008, designed largely to smuggle marijuana.
    The tunnels are concentrated along the border in California and Arizona. San Diego is popular because its clay-like soil is easy to dig. In Nogales, Ariz., smugglers tap into vast underground drainage canals.
    The tunnel is the eighth major passage discovered in San Diego since 2006, a period during which Mexico's Sinaloa cartel has solidified its hold on the prized smuggling corridor. Authorities said Wednesday's tunnel was the first in the San Diego area that was found to be used for cocaine.
    The passage was about 35 feet underground, 4 feet high and 3 feet wide, said Derek Benner, U.S. Immigration and Customs Enforcement's head of Homeland Security Investigations in San Diego. Authorities said the zigzag route suggests that excavators veered off course several times.
    Some of the largest tunnels have been discovered after central Mexico's marijuana harvest in October, which presents drug cartels with a challenge of how to quickly get their product to consumers.
    In November 2011, authorities found a 600-yard tunnel that resulted in seizures of 32 tons of marijuana on both sides of the border, with 26 tons found on the U.S. side, accounting for one of the largest pot busts in U.S. history. The tunnel was equipped with electric rail cars, lighting and ventilation. Wooden planks lined the floor.
    On Thanksgiving Day 2010, authorities found a roughly 700-yard passage equipped with rail tracks that extended from the kitchen of a Tijuana home to two San Diego warehouses, netting about 22 tons of marijuana on both sides of the border.
    Seizures linked to the tunnel include a haul of 3 tons of marijuana in a truck that was stopped by Chula Vista police on Saturday for a traffic violation and 5 1/2 tons of marijuana inside the tunnel, a nearby warehouse and a truck Wednesday, according to prosecutors. The cocaine was found in six suitcases inside a van seen leaving the warehouse Wednesday.

    Los Angeles (AFP) - US and Mexican authorities have unearthed another sophisticated "supertunnel" used to smuggle drugs beneath their common border, the third since 2011, officials said Thursday.
    Zig-zagging for a third of a mile beneath the border between San Diego and Tijuana, the newly-constructed tunnel was equipped with an electric-powered rail system to carry the drugs, as well as ventilation.
    For the first time, agents seized cocaine intended to be smuggled through the tunnel as well as more than eight tons of marijuana, indicating that Mexican drug cartels are getting increasingly "desperate," they said.
    "These cartels are foolish to think they're shoveling under the radar," said US Attorney for Southern California Laura Duffy at a press conference outside the San Diego warehouse where the US end of the tunnel was found Wednesday.
    Investigators released video footage of the tunnel, which they stressed was uncovered before it had been been used.
    In a message to drug smugglers including notably Mexico's Sinaloa cartel, Duffy vowed: "If you continue to build and attempt to use these tunnels, we are determined to make this a big waste of your dirty money."
    Three people were arrested and authorities seized the huge marijuana haul as well as 325 pounds of cocaine, which is usually transported in smaller quantities and does not come through tunnels.
    "Their traditional routes are failing at this point. They're very desperate. They'll do anything they can to get into the US," said Bill Sherman, head of the Drug Enforcement Administration (DEA)'s San Diego office.
    As with two other "supertunnels" discovered in 2011, agents pounced before it had even become operational. "They did not move one gram of narcotics thru that tunnel," said Sherman.
    Law enforcement authorities were increasingly seeing attempts to bring narcotics including cocaine and methamphetamines over the border through tunnels, or micro-light aircraft.
    "Those are acts of desperation," he said.
    The tunnel was built at an average depth of 35 feet, and was 4 feet high by 3 feet wide, said Derek Benner of the US Immigration and Customs Enforcement (ICE) agency's Homeland Security Investigations (HSI).
    Construction likely took a year or more, officials said, adding that it was the work of "engineers and architects." It included hydraulically-controlled steel doors.
    Of the three arrested, two were detained in connection with the cocaine seized, and one, a Mexican national, was held over the marijuana haul. All face a maximum of 10 years to life in jail, officials said.
    In Tijuana, a Mexican security source said the tunnel was accessed at the southern end by a metal stairway down to a depth of 20 meters, from a building about 80 meters from the border fence.
    Discoveries of such underground passageways along the US-Mexico border are not uncommon and authorities say they are used by organized crime groups to traffick drugs and people into the United States.
    The tunnel was the eighth large scale such structure discovered since 2006, and the fifth intercepted since 2010.
    Over 77,000 people have died in drug-linked violence since 2006, when troops were deployed to battle drug cartels, including under ex president Felipe Calderon and his successor Enrique Pena Nieto, who took office last year.

    “[Immigration and Customs Enforcement] does not use information about such individuals or members of their household that is obtained for purposes of determining eligibility for such coverage as the basis for pursuing a civil immigration enforcement action against such individuals or members of their household,” a U.S. Immigration and Customs Enforcement memo reads.
    The memo explains that such information may only be used for administering the Obamacare program and determining eligibility.

    Prospects for comprehensive immigration legislation this year grew murkier on the eve of an all-out push by a coalition of business, religious and law enforcement to persuade the House to overhaul the decades-old system.
    At the same time, proponents seized on a California GOP lawmaker's willingness to back a House Democratic plan as a Senate-passed measure remained stalled in the House.
    Marco Rubio signaled support for the piecemeal approach in the House despite his months of work and vote for the comprehensive Senate bill that would provide a path to citizenship for the 11 million immigrants living here illegally and tighten border security.
    The Florida Republican _ son of Cuban immigrants and a potential presidential candidate in 2016 _ had provided crucial support for the bipartisan Senate bill.
    The Senate opted to pursue a comprehensive bill, and he joined that effort because he wanted to influence the policy that passed the Senate," Rubio's spokesman, Alex Conant, said Monday in explaining Rubio's backing for limited measures.
    Since 68 Democrats and Republicans joined together to pass the Senate bill in June, opponents and many conservatives have stepped up their pressure against any immigration legislation, based not only on their principle opposition but their unwillingness to deliver on Obama's top second-term domestic agenda issue.

    Obama on Monday reiterated his call for Congress to complete action on an immigration overhaul before the end of the year. He said that represented the only way to end the record deportations of immigrants undertaken by his administration, actions he has tried to curtail by allowing young people who immigrated illegally into the United States _ so-called Dreamers _ to remain in the country under certain conditions.

    Most House Republicans reject a comprehensive approach and many question offering citizenship to people who broke U.S. immigration laws to be in this country. The House Judiciary Committee has moved forward with individual, single-issue immigration bills.
    Although House Republican leaders say they want to solve the issue, which has become a political drag for the GOP, many rank-and-file House Republicans have shown little inclination to deal with it. With just a few legislative weeks left in the House, it's unclear whether lawmakers will vote on any measure before the year is out.







    Johnson said he was hopeful that the House could pass one or two of the single-issue bills before the end of the year, and left open the possibility of action early next year _ an election year.
    "I don't think it's the end of world if we can't get it done by early February," Johnson said.
    Jeff Denham of California became the first Republican to back the House Democratic bill.
    "I want to fix it, I want to fix it once for my generation, for my children's generation and a pathway to earned citizenship must be included in immigration reform legislation," Denham said on a conference call with reporters.
    The Senate bill, strongly backed by the White House, includes billions for border security, a reworked legal immigration system to allow tens of thousands of high- and low-skilled workers into the country, and a 13-year path to citizenship for the 11 million immigrants already here illegally.
    The bill from House Democrats jettisoned the border security provision and replaced it with the House Homeland panel's version. That bill, backed by conservative Republicans and liberal Democrats, would require the secretary of Homeland Security to develop a strategy to gain operational control of the border within five years and a plan to implement the strategy.
    Denham said House Democrats were willing to incorporate his separate bill that would allow immigrants who are in the county illegally to become legal permanent residents if they enlist in the military and become a citizen after four years of service with an honorable discharge.

    Authorities believe a Chinese immigrant who fatally stabbed a mother and her four children in their Brooklyn home Saturday night was jealous that the family had been so much more successful in America than him.
    "The family had too much. Their income (and) lifestyle was better than his," a police source told the New York Post Sunday.
    The New York Police Department said the suspect, 25-year-old Ming Don Chen, implicated himself in the stabbings late Saturday in the Sunset Park neighborhood. Chief of Department Phil Banks said the victims "were cut and butchered with a kitchen knife." The Post, citing a police source, reported that Chen showed "no remorse" as he confessed.
    "He made a very soft comment that since he came to this country, everybody seems to be doing better than him," Banks said.
    Chen is a cousin of the children's father and had been staying at the home for the past week or so, Banks added. The Post reported that his last known address was in Chicago.
    He was unemployed after being fired from a string of restaurant jobs he couldn't hold down for more than a few weeks at a time, according to neighbors and relatives.
    Two girls, 9-year-old Linda Zhuo and 7-year-old Amy Zhuo, were pronounced dead at the scene, along with the youngest child, 1-year-old William Zhuo. Their brother, 5-year-old Kevin Zhuo, and 37-year-old mother, Qiao Zhen Li, were taken to hospitals, where they also were pronounced dead.
    The children's father was not home late Saturday evening during the stabbings; he was working at a Long Island restaurant, one neighbor said. The mother tried to call him because she was alarmed about Chen's "suspicious" behavior earlier in the evening, according to Banks.
    When she couldn't reach her husband, Li called her mother-in-law in China, who also could not immediately reach her son. The mother-in-law then reached out to her daughter in the same Brooklyn neighborhood, Banks said.
    The sister-in-law and her husband went to the house at about 11 p.m. and kept banging on the door till someone answered, police said.
    It was Chen, "and they see that he's covered with blood," Banks said. "They don't know who this person is."
    The couple fled, called 911, and detectives investigating another matter nearby responded quickly, Banks said.
    The Post reported that Chen was arrested at the scene, barefoot and covered in blood. Neighbors said he calmly answered officers' questions as he was led into a police car and the bodies were removed from the home.
    However, the paper reported that Chen became violent during questioning, throwing a pair of eyeglasses at a sergeant who served as a Chinese language interpreter before kicking the table where he was cuffed and knocking the sergeant to the ground. He later punched a detective, according to the Post.
    Yun Gao, a cousin of the mother, said the man had recently moved to the area and had been staying with different people. Yun said that she had met Chen in the past and described him as a "crazy" man who had failed to hold down a job as a cook.
    "He's lazy," Yun said Sunday. "He doesn't work too hard."
    Chen was in custody Sunday, but is still awaiting arraignment. It was unclear whether he had an attorney. He faces five counts of murder.

    President Barack Obama, aware the clock on this year’s congressional session is running out, will prod Congress again on Thursday to send him an immigration bill to sign.
    The White House announced Obama’s plan to call for the second time in a week for a “common sense” immigration reform with a statement from the East Room of the White House.
    The announcement Wednesday evening, which was attributed to a “White House official,” said the president would be joined on stage and in the audience by a broad range of immigration supporters for the 10:30 a.m. ET message Thursday.
    The day after the government shutdown ended, Obama issued a “to-do” list for Congress. Immigration reform was on that list, right after the No. 1 issue of fixing the budget and just before passing a farm bill.
    Obama’s request, directed largely at House Republicans, is sandwiched between a Capitol gathering of young immigrants wanting to join the military and a planned convergence of groups of conservative faith, law enforcement and business leaders in Washington Tuesday to pressure the House to move immigration reform legislation
    The House has passed five separate bills on immigration reform and is working on others. House Speaker John Boehner, R-Ohio, on Wednesday said he immigration needs to be addressed and he’s hopeful something could happen by the end of the year.

    Florida Sen. Marco Rubio is warning that if Congress doesn't pass immigration reform, President Obama may act on his own to legalize the 11 million immigrants already in the country illegally.
    Rubio, a potential Republican presidential candidate for 2016 and an author of the sweeping immigration bill that passed the Senate in June but stalled in the House, made the comments Tuesday on "The Morning Show with Preston Scott" on Tallahassee radio station WFLA.
    He noted that the Obama administration took action a year ago to give legal status to many immigrants brought here illegally as children. He said without congressional action, the president might well be tempted to do the same for everyone else here illegally, too.
    "I believe that this president will be tempted, if nothing happens in Congress, he will be tempted to issue an executive order like he did for the DREAM Act kids a year ago where he basically legalizes 11 million people by the sign of a pen," Rubio said.
    Rubio said the possibility highlighted the need for congressional action because the alternative would be legalization without benefits like border security and an E-Verify system to require employers to check their workers' legal status.
    "We can't leave it, in my mind, the way it is because I think a year from now we could find ourselves with all 11 million people here legally under an executive order from the president, but no E-Verify, no more border security, no more border agents -- none of the other reforms that we desperately need," Rubio said.
    The White House disputed Rubio's comments.
    Asked whether Obama would be "tempted" to issue executive orders as Rubio suggested, White House spokesman Bobby Whithorne told The Associated Press, "No. The only solution to this problem is for Congress to fix the broken immigration system by passing comprehensive reform."
    Rubio's comments came with lawmakers back home in their districts for Congress' five-week summer recess, which activists on both sides of the immigration issue are trying to use to make their case for or against action in the GOP-controlled House.
    Under pressure from advocates for reform, several House Republicans have already indicated qualified support for a path to citizenship for the immigrants already here illegally, something that's part of the Senate bill but opposed by many conservatives.
    The conservative American Action Network spent $750,000 on pro-reform commercials. One ad aimed at Florida voters called the legislation "the toughest border security plan ever passed by Congress" and urged viewers to thank Rubio for "keeping his promise and fighting to secure the border."
    Meanwhile those opposed to reform struggled to draw a crowd to a "Stop Amnesty Tour" event in Richmond, Va., Monday night.
    But it remains unclear whether one side will clearly prevail come time for lawmakers to return to Washington in September, or what will happen then. GOP House leaders have said they plan to proceed with the immigration issue with single-issue bills, beginning with border security, so it remains to be seen whether they'll get to the point of entering negotiations with the Senate on a package that could reach Obama's desk.
    Rubio's comments Tuesday tracked with speculation sometimes heard from immigration activists on the left about how to move forward if Congress never sends Obama a bill. The possibility of pressuring Obama to take additional executive actions has been discussed, though most advocates with ties to the White House say it's premature to focus on that idea.
    Rubio recently spoke to about 50 conservative activists and other lawmakers at a meeting of the Senate's tea party caucus. Organizers said he breezed past immigration, instead devoting much of his speech to repealing the health law.

    What about our delegation of the Remember 1986 Coalition that took a bus from Arizona for the DC March For Jobs? We marched with black progressives down Pennsylvania Avenue against S744 with no mention in Gannett publications, where is the fair and balanced reporting here? We also visited all nine Congressional offices and delivered over 10,000 Arizona names on Numbers USA "no amnesty" petitions.

    Gannett pushes amnesty as if their scofflaw advertisers demanded it, are you guys under the gun by Danny's carwash? Did Danny's co-sponsor the bus...or this story?

    Have you no regard for the rule of law? Border or national security, or the fact that amnesty legislation historically accelerates illegal immigration to the point of no return?

    Why not report the victimization and family separation of American citizen's from the hands of criminal illegal aliens, is this against company policy? Is there a black out of coverage for all negative impacts or consequences of illegal immigration, or is Gannett simply pro-illegal immigration to begin with?

    I just don't understand the lack of concern or compassion for American citizens. Why so much emphases on lawbreakers, lawbreaking, and a lack of reporting of the consequences of mass, uncontrolled, organized crime that is taking place here? Why not highlight the long list of illegal immigration enablers in an effort to focus on comprehensive enforcement so that we can start to address the root cause of these crimes?

    But most importantly, what laws can I break so that I too can become a super hero in your publications for ignoring them? Please, I want a 100% complete list so that I can share it with my fellow Americans.

    I wonder if Boehner supports my point of view? Maybe that's why he kept his doors locked. Try reporting that for a change.
